Rental conditions

Article 1 - This contract concerns the rental of a Mobilhome located at the following campsites.

  1. Siblu Les Embruns located in Lège Cap Ferret

  2. Siblu La Réserve located in Gastes

Article 2 - Length of stay.

The tenant who signs this contract for a fixed period may not, under any circumstances, claim any right to remain in the property at the end of the stay.

Article 3 - conclusion of the contract.

The booking becomes effective once the tenant has sent the owner the deposit or the full amount indicated at the time of booking, together with a copy of the contract signed 2 months before the date of the stay. A copy will be sent to the tenant. Under no circumstances may the rental agreed between the parties to this contract be transferred, even in part, to third parties, whether natural persons or legal entities, without the written agreement of the owner. Any infringement of this last paragraph may result in the immediate cancellation of the rental to the detriment of the Tenant, with the proceeds of the rental remaining the definitive property of the Owner. 

Article 4 - Cancellation by the tenant : 

All cancellations must be notified to M. VIEILLEDENT, with acknowledgement of receipt.

 

a) Cancellation before arrival: the deposit remains the property of the owner. The owner may request the balance of the cost of the stay if the cancellation is made less than 30 days before the planned date of arrival. If the tenant does not show up within 24 hours of the arrival date indicated on the contract, the present contract becomes null and void and the lessor will have free use of the flat. All sums paid will remain due.

 

b) if the stay is shortened, the rental price remains the property of the Lessor. No refund will be made.

Article 5 - Cancellation by the lessor

The owner pays the tenant all the sums paid in advance.

Article 6 - Arrival

The tenant must arrive on the day specified in the time slot mentioned on this contract. In the event of late or delayed arrival, the lessee must notify the lessor. 

Article 7 - Payment of the balance

The balance of the rental must be paid at least 1 month before the date of stay.

Article 8 - Inventory

The inventory is carried out by the tenant on arrival and on departure. 

 

 

incoming inventory of fixtures : This inspection must be carried out by the tenant on arrival. The findings are in contradiction with the inventory carried out by the previous tenants. 

 

 

Any damage identified as "new" (not declared by the owner) must be notified to the owner on the first day of arrival. This inventory of fixtures will be carried out in the form of photographs and must include : 

 

The presence and condition of crockery and kitchen utensils

The presence and condition of household appliances

Presence and condition of bedding + pillows and blankets

Presence and condition of indoor and outdoor furniture

The condition of the outside terrace

The condition of the private garden

General state of cleanliness

 

The inventory of fixtures may be completed up to the day after the start of the stay. After this date, no recourse will be possible in respect of any damage and you may be billed for any costs incurred. It is therefore very important to take your time. This inventory of fixtures is the only reference in the event of a dispute.


The exit inventory must mention any damage that occurred during the stay. In the event of breakage, tenants must replace or repair the damaged items at their own expense, failing which the owner will be able to withhold all or part of the deposit paid (Article 9).

 

The cleaning of the premises during normal use is the responsibility of the tenant. In the event of abnormal use of the premises, or exceptional soiling, the amount of the cleaning costs will be invoiced to the tenant, even if the "Cleaning" option has been taken out. Repairs made necessary by negligence or poor maintenance during the rental period will be charged to the tenant.

Article 9 - Security deposit

A security deposit of 800€ (700€ for material goods - 100€ for cleaning) must be paid by the tenant either by cheque or bank transfer. Whatever the method of payment, the deposit will not be cashed. After a joint inventory of fixtures has been drawn up at the end of the rental period, the deposit will be returned, minus the cost of repairing the premises if any damage has been found. The return period may not exceed 7 days. 

 

 

If an authorised animal is present, the damage deposit will be increased by €100, i.e. €750 for material goods and €150 for cleaning.

Article 10 - End-of-stay cleaning service and cleaning deposit

Before your arrival or during your stay, you will have the choice of taking the "End of stay cleaning" service at a cost of €60 (details will be given to you). This service covers normal use of the premises. If the mobile home is returned in an advanced state of dirtiness (e.g. stained bedding and bedding accessories, floor soaked with unidentified liquids, rubbish scattered around the mobile home or dirty toilets), the cleaning deposit will be cashed by the owner after the findings have been photographed by the cleaning service.

 

 

If the tenant does not opt for the cleaning service, he/she is responsible for the upkeep. If the mobile home is not returned in a completely clean condition, the owner will retain the €100 deposit.

Article 11 - Use of the premises

The tenant must ensure the peaceful nature of the rental and use it in accordance with the intended purpose of the premises.

Article 12 - Capacity

This contract is drawn up for a maximum capacity of 8 people. If the number of guests exceeds the capacity, the lessor (or his representative) may refuse to accept additional guests. Any modification or breach of the contract will be considered to be at the customer's initiative.

Article 13 - Animals

Pets are allowed (except category 1 or 2 dogs in accordance with campsite regulations) and MUST be declared when booking. Pets are the sole responsibility of their owners and must be kept on a lead. 

 

 

If this clause is not respected, the owner may refuse the stay without any possibility of reimbursement.

Article 14 - Insurance

The tenant is responsible for all damage caused by him/her. They must be insured and provide the lessor with a certificate of holiday/civil insurance (included in all home insurance policies).

Article 15 - Payment of charges

Water and electricity charges are included in the rental price, for normal use.

Article 16 - Disputes

Any claim relating to the rental will be dealt with by the competent court.

Article 17 - COVID 19 : 

We will reimburse any sums paid if you are unable to travel due to COVID-19 (public authority decree or positive test certificate).
